Calling someone a “freelancer” does not automatically make them an independent contractor.
If you engage consultants, project staff or freelancers, do the contract terms match how they actually work?
Employee or independent contractor? The distinction can affect employment benefits, termination obligations and CPF contributions where applicable.
Look beyond the title:
• Who controls when and how the work is performed?
• Who provides the equipment, materials and workplace?
• Is the person operating their own business?
• Who bears financial risk and has the opportunity to make a profit?
No single factor settles the question. The actual working arrangement matters alongside the agreement.
